About Us

Having established a nationwide practice with Tor Ekeland Law, PLLC in computer fraud trials, partners Tor Ekeland and Mark Jaffe sought to expand their practice to accommodate the serve the needs of its diverse clientele. So we sent Mark out to California to expand on what he has been doing for more than a decade: serving the needs of startups and creative professionals, helping them prosper, and protecting their intellectual property. We’ve found that many emerging companies need informed representation in both New York and California law, but few boutique law firms represent these needs simultaneously.

We founded TorMark Law, a California sister firm to Tor Ekeland Law PLLC. Mark works out of TorMark Law’s Berkeley office, and continues to assist his New York clients.

Mark is a seasoned litigator, with experience in federal and state courts in New York and California. He worked alongside Tor in the Computer Fraud and Abuse Act trials of journalist Matthew Keys and hacker Andrew Auernheimer, and led copyright infringement actions on behalf of architects and other creators. But his practice also includes people and companies who would rather not litigate. At TorMark Law, he builds on this experience to assist creative companies who seek legal representation to protect their interests, comply with applicable regulations, and seek effective means of resolving conflicts.

Here's how we can help:

We craft your trademark strategy. Trademarks are signifiers of your brands. Trademarks identify your goods and services to the public. We understand how you can use your trademarks to help your business grow. That’s why we not only navigate the U.S. and international trademark registration process, but counsel you on how to make your trademarks strong and enforceable.

We are committed to watching your business grow, so much that we are proud to take part in its success. Partner Mark Jaffe has worked with a variety of new companies, overseeing their inception, drafting their contracts, negotiating their agreements with other parties, protecting their intellectual property, guiding them through regulatory and statutory obligations, and resolving disputes efficiently. Mark drew on his pre-law background working with independent record labels in New York and California, and now assists creative enterprises as well as founders on the cutting edge of technological innovation.

Online services face unique copyright compliance issues. We help clients take advantage of the DMCA safe harbor for user-generated content, understand and assert their fair use rights to third-party content, and respond to cease and desist letters alleging copyright and trademark infringement, domain name disputes, and rights of publicity.

Although we love to watch our clients resolve their disputes without resorting to litigation, it often becomes necessary to court. Partners Mark Jaffe and Tor Ekeland have a combined twenty-plus years working on everyone from international banks to local franchisors and architects.

Copyrights protect your literal works, art, music, photographs, architectural works and even your software. They can be registered, licensed, assigned, gifted, enforced and litigated. We work with authors, artists, and other creative professionals who want to maintain and protect their rights. Companies that frequently work with copyrighted material, and especially user-uploaded material, need counseling on compliance with the DMCA safe harbor and other means to immunize themselves from business-crushing copyright infringement actions.

TorMark Law represents authors, artists, and performers secure their rights and monetize their art. The Copyright Act provides for many creators to get their copyrights back 35 years after assigning them to other parties. The process, however, can be complicated and full of traps. That’s where TorMark can help these creators, or their heirs, navigate their process and win back their copyrights so they can enjoy the fruits of their labors.
